THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI CRIMINAL PETITION NO.7475 OF 2015 ORDER:

Accused Nos.1 to 3 in C.C.No.176 of 2015 on the file of the Court of the IV Additional Judicial Magistrate of First Class, Tirupati, filed this petition under Section 482 of the Code of Criminal Procedure requesting to quash the proceedings against them in the above said Calendar Case.

Heard the learned counsel for the petitioners/accused and the learned Additional Public Prosecutor representing the State. Perused the material record.

During the course of hearing, it is submitted by the learned counsel for the petitioners that the Criminal Petition may be disposed of by an appropriate order dispensing with the presence of the petitioners/accused Nos.1 to 3 before the trial Court except on the dates when their presence is necessary before the trial Court. Having regard to the facts and the submissions, this Court is satisfied that the presence of the petitioners/accused Nos.2 and 3 can be dispensed with.

In the result, the Criminal Petition is disposed of dispensing with the personal appearance of the petitioners/accused Nos.2 and 3 in C.C.No.176 of 2015 on the file of the Court of the IV Additional Judicial Magistrate of First Class, Tirupati. However, they shall appear before the trial Court as and when directed by the trial Court. The first petitioner/accused No.1 is given opportunity to move an application for his appearance through a Special Vakalath holder by following the procedure contemplated by law. If the first petitioner/accused No.1 chooses to file such an application before the trial Court, the same shall be disposed of on merits.

Miscellaneous petitions pending, if any, in this petition shall stand closed.
