HON'BLE THE ACTING CHIEF JUSTICE DILIP B. BHOSALE AND THE HON'BLE SRI JUSTICE S.V. BHATT WRIT APPEAL No.538 of 2015 PC: (per the Hon'ble the Acting Chief Justice Dilip B. Bhosale) Heard learned counsel for the appellant-University.

The University has challenged the order, dated 29.11.2012, passed in W.P.No.27438 of 2012. By this order, the writ petition and W.P.No.27236 of 2012 were allowed with direction to the University to pass necessary orders to enable respondent No.2-college to admit candidates against the extra seats permitted by the Indian Nursing Council in B.Sc. (Nursing) Course and for starting the M.Sc. (Nursing) Programme from the current academic year within a period of one week from the date of the order. The concerned academic year was 2012-2013.

After the order in the writ petitions, the University preferred this intracourt appeal. In the appeal, at no point of time, this Court passed any interim order. In view thereof, learned counsel appearing for the University fairly states that the order of the learned Single Judge was complied and even for the academic years 2013-2014 and 2014-2015, the affiliation was granted to respondent No.2-college.

In view thereof, when we expressed that nothing survives in the instant appeal, learned counsel for the appellant-University submits that it may be disposed of with liberty to the University to initiate action, if any, if they so desire against respondent No.2-college for not complying with the norms laid down by the University for running the college. Writ appeal is disposed of as not pressed. It is always open to the University to initiate action under the provisions of the NTR University of Health Sciences Act and its Regulations against any college if they do not comply with the norms laid down for running the college.

Consequently, miscellaneous petitions, if any, also stand disposed of. _________________________ DILIP B. BHOSALE, ACJ
