Petition under Section 438 of Cr.P.C, praying that in the circumstances stated in the affidavit filed in support of the Criminal Petition, the High Court may be pleased to grant Anticipatory bail to the petitioner/Accused No. 1 and 2 in the event of their arrest by P.S. Kalwakurthy in connectlon with Cr.No. 3512019; The petition coming on for hearing, upon perusing the Petition and the affidavit filed in support thereof and upon hearing the arguments of SRI DEEPAK MISRA Advocate for the Petitioner, and of PUBLIC PROSECUTOR, for the Respondent, the Court made the following. By way of this petition, filed under Section 438 CrPC, A.1 and A.2 in Crime No.35 of 2019 on the file of Kalwakurthy police station, Nagarkurnool District, registered under Sections 465, 468, 471 and 420 tead with Section 34 IPC, seek grant of anticipatory bail.
The case of the prosecution against the petitioners / A.1 and A.2 is that they got registered a gift deed purportedly executed by the sister of the first petitioner/A.1 by getting the 2nd petitioner/A.2 to impersonate her. It is however an admitted fact that the said registered gift deed was gotten cancelled by the petitioners on 17.11.2018, vide registered cancellation deed bearing document No.1333 of 2018. It was nearly four months thereafter, on 14.3.2019, that the complaint was lodged by the sister of the first petitioner/A.1, leading to the registration of the crime.
In the light of the aforestated circumstances, this Court is of the opinion that the petitioners / A.1 and A.2 would be entitled to grant of anticipatory bail on some conditions.
The Criminal Petition is accordingly allowed. In the event of arrest of the petitioners/A.1 and A.2 in Crime No.35 of 2019 on the file of Kalwakurthy Police Station, Nagarkurnool District, they shall be enlarged on bail upon their furhishing personal bonds for a sum of Rs.10,000/- (Rupees Ten Thousand only) each along with two sureties for a like sum each to the satisfaction of the Station House Officer, Kalwakurthy Police Station, Nagarkurnool District. The petitioners shall however abide by the conditions prescribed in Section 438 (2) CrPC.
