THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 30879 OF 2017 O R D E R:
The action of the 3rd respondent Station House Officer, Begumpet Police Station in not filing the charge sheet in FIR No. 403 of 2016, dated 21.12.2016, though eight months have been elapsed, is questioned in this Writ Petition. Heard learned counsel for the petitioner.
Learned Government Pleader for Home (Telangana) has obtained written instructions from the Sub-Inspector of Police, Begumpet Police Station, based on which, he submits that on receipt of the private complaint filed by the petitioner from the Court of the XI Additional Chief Metropolitan Magistrate at Secunderabad, a case in Crime No. 403 of 2016 was registered for the offences punishable under Sections 420 and 406 of the Indian Penal Code read with Section 156(3) of the Code of Criminal Procedure on 21.12.2016 against the 4th respondent and others and the investigation is on. While so, the accused in the abovesaid crime filed Writ Petition No. 8544 of 2017 to quash the FIR and the said Writ Petition is pending consideration before this Court. The learned Government Pleader also submits that a further three-months time is required for the Investigating Agency to complete the investigation and file the charge sheet/final report before the Court concerned.
In view of the above submissions, the Writ Petition is closed. It is, however, made clear that the Investigating Agency shall strictly adhere to the instructions, as submitted before this Court, and complete the investigation within three months' time and file
the charge sheet/final report before the criminal Court concerned. No costs.
Consequently, the miscellaneous Applications, if any shall stand closed.
