THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.4242 of 2017 ORDER:

This petition is filed under Section 482 Cr.P.C. to quash the proceedings against the petitioner/accused in C.C. No.186 of 2016 on the file of the Court of Judicial Magistrate of First Class, Bichkunda, Nizamabad District.

The learned counsel for the petitioner submitted that the petitioner filed an application to dispense with his presence on 17.4.2017 and the same was dismissed by the trial court. He further submitted that the trial court issued non-bailable warrant against the petitioner on the same day. The learned counsel for the petitioner sought a direction to the trial court to dispose of the petition to be filed by the petitioner on the same day, to recall the non-bailable warrant issued against the petitioner on 17.4.2017. 3.

Having regard to the facts and circumstances of the case and also the submission made by the learned counsel for the petitioner, the trial court is hereby directed to dispose of the petition if any filed by the petitioner to recall the non-bailable warrant issued against him on 17.4.2017, on the same day, in accordance with law.

With the above direction, the criminal petition is disposed of. Consequently, Miscellaneous Petitions, if any, pending in this Criminal Petition shall stand closed.
