Dhanikonda Mahalaxmi, Khammam Dist., And 3 Otrs. v. The State Of Ts.,Endowments,Hyd.,And 3 Otrs.
THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.41984 OF 2016 ORDER:
The petitioners are claiming to be residents of Bhadrachalam and eking out their livelihood by doing petty business. They are also having lands. In order to widen the roads around Sree Seetharama Chandraswamy Devasthanam at Bhadrachalam, their residential houses and lands were taken for acquisition and they were paid compensation. The compensation was paid after holding negotiations with the house owners including the petitioners. After payment of the compensation, the present writ petition is filed challenging the action of the respondents in not providing any job under rehabilitation/resettlement for acquiring their lands.
A perusal of the cause title shows that the petitioners are aged in the range of 55 to 60 years. Hence, there cannot be any provision for providing jobs to them.
In the counter affidavit filed by the fourth respondent, it is stated that the fourth respondent has nothing to do with the payment of compensation or providing any employment. It is also stated that in view of the financial position of the fourth respondent Devasthanam, it is also not possible to provide employment. When the learned counsel for the petitioners is asked to show any provision or circular entitling the petitioners to claim employment, he is unable to show any provision. In the circumstances, the writ petition is dismissed. Consequently, miscellaneous petitions pending, if any, shall stand closed. There shall be no order as to costs.
