THE HON'BLE SRI JUSTICE SANJAY KUMAR CIVIL REVISION PETITION No. 5160 of 2017 ORDER:

This Civil Revision Petition under Article 227 of the Constitution was preferred by defendants 20 to 23 in O.S.No.1653 of 2013 on the file of the learned XIII Additional District and Sessions Judge, Ranga Reddy District at L.B. Nagar.

The grievance of the petitioners is with regard to the non-disposal of the said suit.

Heard Sri P.S. Rajasekhar, learned counsel for the petitioners and Sri T. Bala Mohan Reddy, learned counsel for respondents 1 to 7/ plaintiffs. Other respondents are shown as not necessary parties to this revision.

Sri P.S. Rajasekhar, learned counsel, would fairly concede that in the light of the circular instructions issued by this Court, the trial Courts are giving priority to pre-2012 matters. He would however state that the Court below is granting adjournments in the subject suit without reference to the provisions of Order 17 Rules 1 and 2 of the Code of Civil Procedure, 1908 (for short, 'C.P.C').

This Court is not inclined to entertain this Civil Revision Petition or issue any direction to the Court below to dispose of the suit within a stipulated time frame. However, as the Court below is bound to follow the mandate of the C.P.C, the Civil Revision Petition is disposed of directing the Court below to keep in mind the provisions of Order 17 Rules 1 and 2 C.P.C while dealing with the subject suit.
