THE HON'BLE SRI JUSTI CE A.RAMALI NGESWARA RAO Writ Petition No.6604 of 2018 Order:

The petitioner claims to be the owner and pattadar of the land admeasuring Ac.4-50 cents, situated in Survey No.348/2 of Palluru revenue village, Kambadur Mandal, Anantapuram District. Pattadar passbooks and title deeds were issued to the petitioner in respect of the said land. She obtained crop loan from the Andhra Pragathi Grameena Bank also. There is electricity service connection. It is alleged that the respondents 3 and 4 are trying to interfere with the said possession without issuing any notice. In the circumstances, the present Writ Petition was filed.

A counter affidavit is filed by the third respondent stating that the said land is a Government land as per RSR, but the petitioner occupied the said land for long time. The case of the petitioner was recommended for assignment by the assignment committee, but no D-Form patta was issued. However, she was given pattadar passbook by the then Tahsildar on 19.03.2016. In the year 2014 it was issued in favour of one Kum. Swetha for an extent of Ac.3-56 cents, but she later on got married and left the village. She is not eligible for assignment. It is categorically asserted that the Tahsildar and the Station House Officer, Kambaduru never disturbed the possession of the petitioner. In view of the assertion made by the third respondent in the counter affidavit, there is no basis for apprehension and the Writ Petition is, accordingly, closed recording the statement made in the counter affidavit of the third respondent.

Consequently, miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. ___________________________ A.RAMALI NGESWARA RAO, J Date: 12.03.2018 Nsr
