THE HON'BLE SRI JUSTICE C.PRAVEEN KUMAR WRIT PETITION No. 20958 of 2016 ORDER:

Heard.

The present Writ Petition came to be filed with the following prayer: 'For the reasons stated in the accompanying affidavit, it is hereby prayed that this Hon'ble Court may be pleased to issue a Writ or order or direction more particularly one in the nature of writ of Mandamus declaring the action of the third respondent in seizing two wheeler, without assigning any reason whatsoever, and not responding even to the legal notice as illegal, arbitrary and highandednessa nd consequently direct the third respondent to release the vehicle viz. Bajaj Pulsar vide AP 27 Q 4141 to the petitioner, forthwith and direct the respondent to pay damages of Rs.

10,000/- for the undue suffering meted out to the petitioner, in the interest of justice and to pass such order and further order as this Hon'ble Court may deem fit and proper in the circumstances of the case'. Learned Government Pleader for Revenue on written instructions states that on 06.04.2016, while conducting vehicle check within the limits of Vetapalem Police Station, the respondent - police detained a red colour pulsar motor cycle driven by the petitioner in rash and negligent manner. It is stated that the said vehicle is neither having number plate nor the petitioner produced his driving license. It is further stated that when the petitioner was asked to produce relevant documents, he failed to do so till date.

In view of the above, the writ petition is disposed of directing the petitioner to produce all the documents showing the ownership over the said vehicle, in which event, the respondent-police shall consider the same in accordance with law.

Miscellaneous petitions, pending if any, shall stand closed in the light of this final order. No order as to costs.
