THE HON'BLE SRI JUSTICE S.V.BHATT WRIT PETITION No.31689 of 2013 ORDER:
Heard Mr.G.Naresh Kumar for petitioner and the Assistant Government Pleader for respondents. The subject matter of the writ petition is Acs.2.06 guntas, Acs.3.25 guntas and Ac.0.32 guntas respectively in Sy.Nos.927, 928 and 931 corresponding to old Sy.No.686/5 of Nandipet Village, Nizamabad District.
The complaint of petitioner is that the respondents are interfering with the possession and enjoyment of the petitioner on subject matter of the writ petition. The 3rd respondent filed counter-affidavit and has explained the details of old survey number, identified the subject matter of writ petition as Sy.No.686/4AA and further explained that the petitioner had an extent of Ac.1.32 1⁄4 guntas in Sy.No.686/5 of Nandipet Village. The petitioner sold Ac.0.17 3⁄4 guntas to nine different persons. The petitioner is now trying to grab the land in Sy.No.686/4AA of Nandipet Village. The 3rd respondent submits that the petitioner has land in Sy.No.686/5 and cannot complain the steps taken for protecting Government land in Sy.No.686/4AA. The 3rd respondent filed several annexures in support of the claim of Government in Sy.No.686/4AA.
Having regard to the stand taken in the counteraffidavit, the learned counsel for petitioner does not press the grievance in the writ petition.
The Writ Petition is closed accordingly. No order as to costs.
Miscellaneous petitions, if any, pending, shall stand closed.
