THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.10520 OF 2016 ORDER:

The prayer of the petitioner in this case is as under: "For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue any writ, order or direction more particularly one in the nature of writ of mandamus declaring the action of the official Respondents in without conducting any investigation or visiting the Tahsiidar Maheswaram, or enquiring or verifying the record and simply closed the case by furnishing final report stating that the allegations are of civil in nature as is illegal, arbitrary, and against the principles of natural justice and in violation of Articles 14 and 21 of the Constitution of India and consequently direct the official respondents to refer the matter to CCS Hyderabad to investigate into matter in Crime No. 546 of 2015 of P.S. Punjagutta, Hyderabad, and pass such other order or orders as deemed fit and proper in the circumstances."

As the petitioner is aggrieved by the conclusion arrived at by the police authorities as embodied in the final report filed by them before the competent criminal court in relation to Crime No.546 of 2015 on the file of Panjagutta Police Station, Hyderabad, it would open to him to avail appropriate statutory remedies under the Code of Criminal Procedure, 1973. Without taking recourse to the effective alternative remedies provided to him under the statute, the petitioner cannot approach this Court directly by invoking its extraordinary jurisdiction under Article 226 of the Constitution.

On this short ground, this writ petition is dismissed. This order shall however not preclude the petitioner from availing appropriate statutory legal remedies before the proper forum in accordance with law.

Pending miscellaneous petitions, if any, shall also stand

dismissed. No order as to costs.
