SMT JUSTICE T.RAJANI CRIMINAL PETITION No.2428 OF 2018 ORDER:

This Criminal Petition is filed seeking for grant of bail to the petitioner, who is accused No.3, in Crime No.20 of 2017 on the file of the Station House Officer, Kothakota Police Station, Visakhapatnam District. The offences alleged are under Sections 25 and 8(c) R/w.20(b)(ii)(B) of the Narcotic Drugs and Psychotropic Substances Act, 1989 (for short, 'the NDPS Act'). 2.

Heard the learned counsel for the petitioner, learned Public Prosecutor appearing for the respondent-State, and perused the record. 3.

The case of the prosecution is that the petitioner transported ganza, which is being commercial quantity, in his vehicle by receiving an amount of Rs.30,000/- to Rs.50,000/-, which is sizeable amount. Further, it also appears that the petitioner is alleged to have drove the vehicle two times in respect of this crime.

Considering the fact that the petitioner not only transported the ganza but also arranged his vehicle, this Court is not inclined to consider the submission of the petitioner's counsel, that the petitioner has been languishing in jail since 03.04.2017, for considering his bail application. 5.

Hence, in the light of the above, this Criminal Petition is not maintainable and is, accordingly, dismissed.

As a sequel, the miscellaneous applications, if any pending, shall stand dismissed.
