THE HONOURABLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.7893 OF 2019 ORDER:

Petitioner prays for a writ of mandamus alleging that the respondent No.3 is making construction obstructing the passage to the petitioner's house bearing Plot No.69, Jameel Colony, Errakunta, R.R.District and thereby preventing ingress and aggress to the public. In similar circumstances, having regard to filing of large number of similar petitions before this Court, the Division Bench of this Court in W.P.No.20000 of 2006 vide order dated 27.10.2006 issued general directions which read as under:

"1.

The Commissioner and/or other authorities concerned of the Municipal Corporations or Municipalities in the State of Andhra Pradesh should within a period of 15 days from the date of receipt of representation made or notice sent by any person with a complaint regarding illegal/unauthorized construction, invariably give a written response to the person sending representation or notice.

2.

The concerned authorities of the Municipal Corporations or Municipalities shall take necessary measures/steps to ensure that no one is allowed to raise construction without obtaining the building plan sanctioned from the competent authority and no construction is made in violation of the sanctioned plan or master/zonal plan/lay out."

Writ Petition is disposed of strictly adhering to the directions of the Division Bench as extracted above. No order as to costs.

Miscellaneous petitions pending in the writ petition, if any, shall stand closed.
