HON'BLE SRI JUSTICE SURESH KUMAR KAIT AND HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI W.P.No.6574 OF 2018 ORDER: (ORAL) (per Hon'ble Sri Justice Suresh Kumar Kait) Vide the present petition, the petitioners seek direction thereby declaring the action of the respondents in clarifying the seniority of PCs of Armed Reserve or Andhra Pradesh Special Police transferred to Civil shall be determined with reference to their date of first appointment in former category i.e., Armed Reserve (AR) vide impugned proceedings in Rc.No.674/E3/2016 dated 22.10.2016 and also declaring the consequential Provisional Seniority List C.No.32/A-1/2017 dated 01.01.
2017 issued by the 3rd respondent including the action of the respondents taking steps to send the Juniors to the petitioners for pre-promotional training for the post of Head constables vide Fax/Radio message dated 02.12.2017 without preparing the Final Seniority List by considering the objections of the petitioners including the orders in O.A.No.186 of 2018 dated 06.02.
appointment in A.P.S.P. for the purpose of seniority and direct to grant all consequential benefits.
2. After some arguments from both sides of the parties, it is revealed that the petitioners filed objections to the provisional list dated 01.01.2017 and the matter is pending issue of final Seniority List.
3. In any event the clarification issued by the Director General of Police dated 22.10.2016 is in respect of conversion of Police Constables of 2013 batch alone.
4. Keeping in view the facts and circumstances of the case and the fact that the petitioners have filed objections to the provisional Seniority List dated 01.01.2017, the respondents are directed to decide their representations and issue a fresh Seniority List within two (02) months from the date of receipt of this order.
5. It is made clear that till the decision is taken by the respondents on the objections filed by the petitioners, no further batch for pre-promotional training shall be sent.
6. We make it clear that the objections filed by the petitioners shall be decided by the respondents by a reasoned order.
7. In view of the above, the Writ Petition is disposed of. There shall be no order as to costs.
Miscellaneous petitions, if any, pending shall stand closed.
