O R D E R

The grievance of the petitioners in this case was as to the alleged inaction on

the part of the police authorities in disposing of their representations dated 10.04.2012 and 19.04.2012. By way of the said representations, the petitioners expressed their apprehension that they would be dispossessed from their property by certain named persons who were said to be highly influential and who were categorized as land-grabbers. The plea of the petitioners in these representations was that the police should extend its cooperation to protect their possession from the named persons.

In the affidavit filed in support of the writ petition, there is no mention of any provision of law which empowers the police authorities to act upon the petitioners' representations and take steps to protect their alleged possession. In the event the petitioners expect any move on the part of certain private persons to interfere with their lawful possession, if any, their remedy lies elsewhere and they cannot seek police intervention in anticipation of an offence being committed. Further, the record reflects that when this matter came up for hearing before this Court on 27.04.2012, this Court took note of the fact that the names of certain persons were mentioned in the complaints made by the petitioners, but curiously, they were not made respondents. When this was pointed out, the learned counsel for the petitioners had sought time to take steps. However, no steps have been taken in this regard till now.

Thus, for reasons more than one, this Court is of the opinion that this writ petition cannot be maintained and the same is accordingly dismissed. Pending miscellaneous petitions shall also stand dismissed. No order as to costs. ______________________ SANJAY KUMAR, J 4th JUNE, 2015 PGS
