THE HON'BLE DR. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.9310 OF 2017 ORDER:
Heard learned counsel for the petitioner, before ordering notice to the respondents 2 to 4, among whom R3 and R4, represented by R2 - mother (wife of the petitioner herein) and also heard the learned public prosecutor, representing the 1st respondent - State.

The impugnment is against the execution order of the maintenance claim before the learned Judge, Family Court. There is nothing wrong in this, but for from the plea that he is already terminated from service on compulsory retirement due to medical grounds and he is not in a position to pay. 3.
Having regard to the above, the warrant by levy for recovery issued against him in execution of the maintenance claim is suspended for a period of four weeks from today, so that he can clear all the arrears meantime. If he failed to pay the same within four weeks from today, the learned Magistrate can enforce.

Accordingly and with the above direction, this criminal petition is disposed of for nothing more to entertain the petition. Miscellaneous petitions pending consideration, if any, in this case shall stand closed in consequence. ______________________________ DR.B.SIVA SANKARA RAO, J 06.10.2017 SS
