Heard counsel for the petitioner and the Government Pleader for Home appearing for the respondents. 2.
Petitioner is accused No.1 in Crime No.106 of 2016 dt.24.08.2016 registered by the 4th respondent-police, basing on a complaint given by one Pagadala Srilaxmi, W/o Balarami Reddy, under Sections 120(b), 302, 307 read with 34 IPC and Section 3(5) of SC/STs (POA) Act, 1989 and Section 27 of Arms Act.

Petitioner contends that accused No.2 had been arrested by the police on 31.08.2016 but has not been produced before the Court and a Writ of Habeous Corpus has been sought in this Court in W.P. No.30786 of 2016, and that if the respondents arrest him, he would also be kept in illegal custody without him being produced before the concerned Court. Therefore, he seeks a direction from this Court for producing him before the concerned Court as and when the petitioner surrenders.

Counsel for the petitioner reiterates the said contentions and states that the petitioner would surrender before the 3rd respondent on 20.09.2016 and that on such surrender, the
3rd respondent be directed to produce the petitioner before the concerned Court in Crime No.106 of 2016.

The Government Pleader for Home appearing for respondents is also agreeable to this suggestion. 6.
Therefore, this Writ Petition is disposed of directing the petitioner to surrender before the 3rd respondent on or before 20.09.2016, and on such surrender of the petitioner, the 3rd respondent is directed to produce the petitioner on the same day before the concerned Criminal Court in connection with Crime No.106 of 2016 on the file of the 4th respondent. There shall be no order as to costs.

Consequently, miscellaneous petitions pending, if any, shall stand dismissed.
