SMT JUSTICE T.RAJANI CRIMINAL PETITON No.2436 OF 2018 ORDER:

This petition is filed seeking for grant of anticipatory bail to the petitioners, who are A1 to A4, in Crime No.92 of 2017 on the file of Mylavaram Police Station, Krishna District. The offences alleged are under Sections 324, 506 r/w 24 IPC and Section 3(1)(s) of SC/ST POA Amended Act, 2015. 2.

Heard the counsel for the petitioners and the Public Prosecutor appearing for the respondent.

The case of the prosecution is that these petitioners, who are fetching water, obstructed the defacto complainant, on the ground that she belongs to Mala Community. Hence, the said allegations would attract the offence under SC/ST Act, under Section 18 of which Act, a bar is laid for granting anticipatory bail. The public prosecutor also submits that these petitioners are involved in several other crimes. 4.

Hence, in view of above facts, this court opines that this is a not a fit case for granting anticipatory bail. 5.

Accordingly, the Criminal Petition is dismissed.

However, the petitioners are at liberty to file a petition seeking for regular bail by surrendering themselves before the court below having the jurisdiction. The court below shall dispose of the bail application on merits, if any filed, expeditiously,

preferably on the same day, subject to the pressure of other work.
