THE HON'BLE SRI JUSTICE RAJA ELANGO WRIT PETITION No.35773 of 2016 ORDER:

The writ petition is filed by the petitioner seeking a writ of mandamus declaring the action of the respondents 3 and 4 in seeking to dispossess the petitioner from his land to an extent of Acs.5.44 cents in Survey No.81 situated at Mohanapuram Village, Gangavaram (Agency) Mandal, East Godavari District, without following due process of law, as illegal and arbitrary and consequently, to direct respondents 3 and 4 not to dispossess the petitioner from his land.

Heard and perused the material.

Learned counsel for the petitioner submits that the respondents 3 and 4 are trying to dispossess the petitioner from the land mentioned above at the instance of the fifth respondent without following due process of law and as such, he prays this Court to direct the respondents 3 and 4 not to dispossess the petitioner forcibly from the subject premises at the instance of the fifth respondent.

Learned Assistant Government Pleader for Home (Andhra Pradesh) submits that the respondents 3 and 4 are not interfering with the affairs of the petitioner and they are not trying to dispossess the petitioner from the subject land.

Considering the rival submissions made by both the counsel, the writ petition is disposed of with a direction to the respondents 3 and 4 not to interfere in the civil disputes between the petitioner and the fifth respondent and also not to dispossess the petitioner from the subject land without following due process of law.

The writ petition is accordingly disposed of. Consequently, miscellaneous petitions, if any shall also stand disposed of. _____________________ JUSTICE RAJA ELANGO 24.10.2016 pln
