CVNR, J & TR, J FCA 11/2016 JUDGMENT: (per the Hon'ble Sri Justice C.V. Nagarjuna Reddy) This appeal arises out of order and decree dt.09.04.2014 in F.C.A.O.P. No.1116 of 2009 on the file of the Judge, Family Court-cum-V Additional District and Sessions Judge, Visakhapatnam. A perusal of the proceedings sheet shows that on 02.09.2016 the case was adjourned to 22.09.2016. On the next date of hearing, i.e., on 29.09.2016 there was no representation. Even today, when the case is called, no one represented the appellant. From the repeated absence of the counsel for the appellant, it is reasonable to presume that the appellant is not interested in pursuing his cause in the appeal. The appeal is accordingly dismissed for non-prosecution. As a sequel to dismissal of the appeal, F.C.A.M.P. No.21 of 2016 shall stand disposed of as infructuous.
