IN THE HIGH COURT OF JUDICATURE AT HYDERABAD

FOR THE STATE OF TELANGANA & THE STATE OF ANDHRA PRADESH (Special Original Jurisdiction) WEDNESDAY, THE TWENTY EIGHT DAY OF JANUARY TWO THOUSAND AND FIFTEEN PRESENT THE HON'BLE SRI JUSTICE VILAS V. AFZULPURKAR WRIT PETITION No.40935 of 2014 BETWEEN M.A.Rasheed ... PETITIONER AND The State of Telangana, Rep. by its Principal Secretary, Secretariat Buildings, Hyderabad and others.

...RESPONDENTS The Court made the following:

ORDER:

Heard.

2. Petitioner alleges that respondent No.4 has been treating him as a suspect in a crime and has been calling him to the police station with a view to detain him, though no crime is registered against the petitioner.

3. On the last date of hearing, learned Government Pleader was required to file an affidavit of respondent No.4. Accordingly, a counter affidavit is filed, which states that a case in Crime No.201 of 2014 was registered against one Md.Fasiuddin, R/o.Khanapur, who is the Technical Assistant in Forest Department and he was shown as A1 and investigation was taken up. However, during the course of investigation, it came to light that petitioner was also involved in the said crime and thereby, he was also shown as A2 along with A3 to A8. Accordingly, on 21.01.2015, petitioner was arrested and was produced before the Judicial Magistrate of First Class, Adilabad and on 22.01.2015, the said criminal court granted bail to the petitioner and he was released. The said crime is, accordingly, pending investigation. The allegations made by the petitioner of harassment and detention etc., are denied.

4. Since the petitioner is shown A2 in the crime and was already released on bail, in my view, nothing further survives for consideration in this case except directing respondent No.4 to complete the investigation expeditiously and take further action in accordance with law.

With the above direction, writ petition is disposed of. As a sequel, the miscellaneous applications, if any, shall stand closed. There shall be no order as to costs. _____________________ VILAS V. AFZULPURKAR, J January 28, 2015 LMV
