THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.10674 of 2017 ORDER:

This Writ Petition is filed for the following relief: "For the reasons stated in the accompanying affidavit, it is prayed that this Hon'ble Court may be pleased to issue writ or direction preferably Writ of Mandamus declaring the inaction of respondent Nos.2 and 3 in considering the claim of the petitioner for grant of compensation for land acquisition under Polavaram Project in respect of land to an extent of Acs.4.09 guntas in Survey No.164 of Repakagommu Village, Velairpadu Mandal, West Godavari District, as illegal, arbitrary and violative of principles of natural justice and consequently direct respondent Nos.2 and 3 to conduct enquiry and pay compensation to the petitioner as per law."

When the matter is taken up, a copy of written instructions, dated 24.03.2017 furnished by the Sub-Collector & Land Acquisition Officer, Kukunoor, West Godavari District, to the Office of the learned Government Pleader for Land Acquisition (Andhra Pradesh), Hyderabad, is produced before this Court by the learned Government Pleader, and the same is placed on record. In the said instructions, it is stated as follows: "In this connection, it is submitted that the writ petitioner did not mention the details of the Preliminary notification or the Declaration in which the R.S.No.164 was notified. As seen from the award passed for an extent of Acs.125.29 guntas during the month of January, 2017, R.S.No.164 was not covered in the award. The writ petitioner may be directed to approach the Land Acquisition Officer with relevant details

AVSS, J W.P.No.10674 of 2017 with respect to the notification/declaration wherein R.S.No.164 was notified."

On noticing the same, a request is made by the learned counsel for the petitioner that the petitioner would approach the Land Acquisition Officer for redressal of his grievance and for coordination of the same by the Land Acquisition Officer. Recording the said submission, the Writ Petition is disposed of, leaving it open to the petitioner to file necessary representation before the Land Acquisition Officer for redressal of his grievance.

Consequently, Miscellaneous Petitions, if any pending in this Writ Petition, shall stand closed. No order as to costs. _________________ A.V.SESHA SAI, J 10th APRIL, 2017.
