THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION NO.2450 OF 2018 ORDER:

This petition is filed by the petitioner-A2 under Section 482 Cr.P.C. to quash the proceedings in Cr.No.495 of 2017 on the file of the Station House Officer, Krishnalanka Police Station, Krishna District, registered for the offence punishable under Section 306 IPC.

Heard learned counsel for the petitioner, learned Assistant Public Prosecutor representing the State and perused the record.

Learned counsel for the petitioner-A2 would submit that the petitioner has a small baby and she is falsely implicated in this case.

As per the report lodged with the police, dated 10.07.2017, there are allegations against the petitioner-A2 and other accused in this case driving the deceased, who is the sister-in-law of this petitioner, to commit suicide. The innocence or otherwise of the petitioner-A2 would be determined in the course of investigation. It cannot be held that the petitioner is an innocent person and the allegations do not constitute the offence punishable under Section 306 IPC. The petition is devoid of merit and is liable to be dismissed.

5. Accordingly, the Criminal Petition is dismissed. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
