This appeal is filed by the second respondent-Insurance company under Section 173 of the Motor Vehicles Act, challenging the judgment and award dated 17.11.2005 passed in O.P. No.1802 of 2003 on the file of the Court of XII Additional Chief Judge, City Civil Court (Fast Track Court), Hyderabad.

This Court, by order dated 07.4.2017, permitted the appellant to serve notice on the second respondent herein-owner of the offending Bus bearing No.AP 5 X 8993, failing which the appeal stands dismissed. A perusal of the record reveals that the appellant did not comply the said order; hence, the appeal stands dismissed against owner of offending Bus. In view of the same, no purpose will be served by keeping the matter pending. 3.
