HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.27904 of 2005 ORDER :
This writ petition is filed seeking to issue a Writ of Certiorari calling for the records relating to and connected with I.D.No.68 of 2000 on the file of the 1st respondent - Industrial Tribunal-cum-Labour Court, and quash the award dated 27.06.2005 passed therein, holding it as illegal and arbitrary. The petitioner is seeking the relief to set aside the orders of removal and to reinstate the petitioner into service with all consequential benefits.
A perusal of the record discloses that the petitioner has attained the age of superannuation during the pendency of the writ petition and the relief of reinstatement into service sought by the petitioner at this point of time may not be feasible. Therefore, this Court is of the considered view that this writ petition can be disposed of directing the 2nd respondent Corporation to extend the service benefits to the petitioner for the services rendered by him for the period prior to his removal from service, and pay the same, if not already paid, within a period of four (4) weeks from the date of receipt of a copy of this order.
With the above observations, this writ petition is disposed of. No order as to costs.
