THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION NO.2445 OF 2018 ORDER:
This petition is filed by the petitioner-accused under Section 482 Cr.P.C. to quash the proceedings in Cr.No.53 of 2018 on the file of the Station House Officer, Kaikaluru Town Police Station, Kaikaluru, Krishna District, registered for the offences punishable under Sections 468 and 472 IPC. 2.
Heard learned counsel for the petitioner, learned Assistant Public Prosecutor representing the State and perused the record.

Learned counsel for the petitioner would submit that the petitioner-accused is an innocent person and falsely implicated in this case. He has nothing to do with the alleged forgery of documents etc., The allegations do not constitute the offences referred above and ultimately, prayed to allow the petition.

On the other hand, learned Assistant Public Prosecutor opposed the relief sought for by the petitioner in the petition?

As per the material placed on record, the 2nd respondent-de facto complainant made a report to the police on 19.02.2018 wherein he clearly and categorically stated that he is an Advocate in Kaikaluru. His office is situated at Station Road, Kaikaluru. He is a Notary. The petitioneraccused, who is working as a Journalist of a newspaper is doing job works at that station road. On 19.02.2018, he received a notarized caste certificate. The petitioner-accused who is doing job work forged the signature of L.Satyanarayana, Advocate, Eluru, using his rubber stamp
and started notarizing the documents without any legal entitlement. The petitioner-accused cheated the society and public at large. There are allegations of signing as Notary without there being a licence to do so. There are also allegations of preparing the rubber stamp for that purpose and forging the signatures of the Advocates. The allegations do constitute cognizable offences. The allegations require investigation. It cannot be held that the petitioner is an innocent person. The petition is devoid of merit and is liable to be dismissed.
6. Accordingly, the Criminal Petition is dismissed. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
