The petitioner is the accused in Crime No.8 of 2019 on the file of the Bhanoor Police Station, Sangareddy District, registered under Section 420 IPC read with Section 7 of the Essential Commodities Act, 1955 (for short, 'the Act of 1955'). By way of this petition filed under Section 438 Cr.P.C., he seeks grant of anticipatory bail. The case of the prosecution is that the petitioner was apprehended in possession of Blue Kerosene meant for public distribution, while he was in the process of converting it to white kerosene. This Court is informed that the petitioner is also shown as one of the accused in Crime No.13 of 2019 on the file of Begum Bazar Police Station, Hyderabad, which was also registered under Sections 420 and 406 IPC read with Section 7 of the Act of 1955.

The learned Assistant Public Prosecutor, State of Telangana, would inform this Court that the investigation is not yet completed. As the case involves misuse of kerosene meant for public distribution, this Court is not inclined to extend any indulgence to the petitioner at this stage. Custodial interrogation may be required to elicit the source of the PDS kerosene which is being misused. Therefore, no grounds are made out for grant of anticipatory bail.
