THE HON'BLE DR.JUSTICE SHAMEEM AKTHER CRIMINAL PETITION NO.2462 OF 2018 ORDER:

This petition is filed by the petitioners-A1 and A3 to A5 under Section 482 Cr.P.C. to quash the proceedings in Cr.No.20 of 2018 on the file of the Station House Officer, Maheswaram Police Station, Rachakonda District, registered for the offences punishable under Sections 447, 504 and 506 r/w149 IPC.

Heard learned counsel for the petitioners, learned Assistant Public Prosecutor representing the State and perused the record.

As per the report, dated 06.02.2018, the petitioners alleged to have trespassed into the land and threatened the de facto complainant and his wife. In the said report, there are no details of land and its survey number. It is brought to the notice of this Court the order passed by the IX Addl. Senior Civil Judge, L.B. Nagar, R.R. District, dated 30.01.2018 in I.A.No.122 of 2018 in O.S.No.180 of 2018, wherein the learned Senior Civil Judge was pleased to grant status quo in respect of the land belonging to the petitioners, which they have purchased under registered sale deeds. The dispute appears to be civil in nature. The interest of the petitioners is required to be protected. However, the investigation has to go on to find out the truth or otherwise of the allegations.

In the result, the Station House Officer/Investigating Officer concerned is directed to complete the investigation and file final report, without arresting the petitioners-A1 and A3 to A5 in the above crime.

Accordingly, the Criminal Petition is disposed of. Miscellaneous petitions, if any pending in this Criminal Petition shall stand closed.
