HON'BLE SRI JUSTICE S.V.BHATT W.P.No.32441 OF 2012 ORDER:

The petitioners pray for the following relief: "..to issue a writ in the nature of a Writ of Mandamus or any other appropriate writ, direction, order or orders declaring the action of the respondents in not granting patta to the petitioners in respect of Ac.125.71 Sy.No.24 Regd.Doc.No.L.1467/68 covered by registered sale deed dated 26.7.1968 and for Ac.140.20 cents in SY.No.24,25 and 26 Regd.Doc.No.619/69 covered by sale dated 28-3-1969 as wholly arbitrary, illegal, and void and consequently direct the respondents to grant ryothwari pattas to the petitioner for the afore mentioned lands.." Pursuant to the directions of this Court, the 3rd respondent has placed the status report wherein it is stated that "appropriate orders shall be passed and issued on the petition filed by petitioners subject to outcome of the enquiry."

The Assistant Government Pleader appearing for 3rd respondent submits that the 3rd respondent will pass appropriate orders as stated by R.3 in the report within four months from the date of receipt of a copy of this order. This Court is of the view that the claim of petitioners for grant of ryotwari patta is still pending with the competent authority and the same has to be decided only by 3rd respondent. 3rd respondent is prepared to pass orders after completing the ongoing enquiry. Hence, the writ petition is disposed of by this order. The 3rd respondent completes the enquiry already initiated on the petition filed by petitioners within four months from the date of receipt of a copy of this order and shall communicate the outcome to petitioners. No order as to costs.
