ORAL ORDER:

Heard learned counsel for petitioner and learned Government Pleader for Home.

Petitioner claims that he is owner of vehicle bearing No. TS-16 UB 5620. He alleges that on 23.3.2018 while he along with his family members were coming from his house, respondents 4 to 6 entered into his car, caught hold of his shirt collar, forcibly pushed him out of the car, beat him with hands on his right hand and backside of the waist and forcibly took his mobile, ATM card and Rs.2000/- and ran away in his car. Petitioner now alleges that his vehicle is seized and kept in the police station and police are not giving interim custody of the same. Alleging inaction in granting interim custody of the vehicle, this writ petition is filed.

On instructions, learned Government Pleader informs the Court that Crime No. 39 of 2019 was registered on 29.3.2018 in Bheemgal police station; vehicle was seized and deposited in the Court of Judicial First Class magistrate at Armoor on 31.3.2019. 4.

Since the vehicle is already deposited in the competent Court, it is open to the petitioner to file appropriate application for release of the vehicle.
