Leave about the fact that the respondent - plaintiff/decree holder stated died orally with no proof. In the revision maintained by the petitioner/judgment debtor - defendant of E.P.No.13 of 2014 for recovery of the amount by sale of the movable and immovable property, as the case may be, from the conditional order of this Court, while entertaining the revision stated complied with in deposit of Rs.8,00,000/- out of the decree amount under execution of more than Rs.19,00,000/-, the revision is disposed of, by granting time to the petitioner/decree holder to pay the balance amount within six weeks from date of receipt of the order, if at all the LRs are brought on record by the decree holder of the E.P. under Section 50 of CPC for there is no limitation to continue the proceedings by the LRs apart from any otherwise maintainability of fresh E.P. However, the deposit shall be made to the credit of the suit; if no deposit made, subject to bringing of LRs, the E.P. proceedings can continue.
