HON'BLE Dr. JUSTICE B. SIVA SANKARA RAO Crl.P.M.P.No.5417 of 2015 AND CRIMINAL PETITION No.5372 of 2015 ORDER :
This criminal petition is filed by the petitioner/accused under Section 482 Cr.P.C seeking to quash the proceedings in C.C.No.97 of 2013 on the file of the Special Judicial First Class Magistrate-cumSpecial Mobile Court, Vizianagaram, (Old C.C.No.335 of 2013 on the file of the Additional Judicial First Class Magistrate, Vizianagaram), for the offences punishable under Sections 498-A, 506 and 509 IPC and Sections 3 and 4 of the Dowry Prohibition Act, 1961 (for short, 'the Act').
2. Pending the criminal petition, Crl.M.P.No.5417 of 2015 is filed by both sides with joint memo seeking permission to compound the criminal case stating that the matter is amicably settled between the parties out side the Court.
3. The de facto complainant and petitioner/A.1 present. Most of the offences are compoundable even with the permission of the Court but for the offences under Sections 3 and 4 of the Act otherwise non compoundable under Section 320 Cr.P.C. Having heard the parties, permission is thereby accorded as the parties stated that they have amicably settled the matter to purchase peace. Accordingly, the offences are compounded in terms of their compromise at the instance of the de facto complainant since present with the petitioner/A.1.
4. Accordingly, Crl.P.M.P.No.5417 of 2015 is allowed. Consequently, the criminal petition is allowed and all the proceedings relating to C.C.No.97 of 2013 on the file of the Special Judicial First Class Magistrate-cum-Special Mobile Court, Vizianagaram, (Old C.C.No.335 of 2013 on the file of the Additional Judicial First Class Magistrate, Vizianagaram), are quashed against the petitioner. The
bail bonds of the petitioner, if any, shall stand cancelled.
