ORAL ORDER:
Heard learned counsel for petitioner and learned standing counsel for respondents.
On 5.3.2019 notice was issued to petitioner alleging that various defects were noticed in the power supply connection and provisional assessment of additional electricity charges payable by the petitioner were arrived at Rs.2,48,298/- and petitioner was asked to pay 50 % of the said amount within 15 days for continuation of the supply. In the said notice, petitioner was also given option to represent before the Superintending Engineer within 15 days from the date of service of the notice. Petitioner neither accepted nor submitted representation within the time granted to him but submitted a representation on 3.4.2019 which was acknowledged by the office of Superintending Engineer on 4.4.2019. This writ petition is filed alleging disconnection of the power supply.
Since representation made by the petitioner dated 3.4.2019 was received by the office of the Superintending Engineer, without entering into the merits of the matter, writ petition is disposed of directing Superintending Engineer-second respondent to pass appropriate orders on the representation of the petitioner within three weeks from the date of receipt of copy of this order. Further, subject to petitioner paying an amount of Rs.85,000/- (Rupees eighty five thousand only) power supply shall be restored and such restoration shall be subject to further orders to be passed by the second respondent. No costs. Miscellaneous petitions, if any pending, are closed.
