HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITION NO.204 OF 2009 ORDER:
The action of the respondents, in seeking to disconnect water supply to the petitioner's unit by letter dated 05.01.2009, is subjected to challenge in this Writ Petition as being arbitrary and illegal. On the ground that payment for the month of October, 2005 was not made, and there was a variation in the bills, the petitioner was asked to clarify. Alleging that, pending clarification, water connection was being disconnected, the petitioner invoked the jurisdiction of this Court. In its order, in WPMP No.219 of 2009 dated 12.01.2009, this Court held that, if water connection has already been disconnected, it shall be restored forthwith on payment of water charges; however, further proceedings, with regard to submission of explanation and passing a final order, may go on.
As the interim order is conditional, and required the respondents to restore water supply only on payment of water charges and all arrears, and as the Learned Judge has also observed that, all further proceedings, with regard to submission of explanation and passing of final orders, may go on, no further orders need be passed in this Writ Petition. Suffice it to make it clear that, in terms of the interim order, it is open to the respondents to proceed and pass final orders, in case no final orders have been passed as on date.
