HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No. 20406 of 2016 ORDER:
Heard learned counsel for the petitioner and Government Pleader for Mines and Geology. With the consent of both the parties the writ petition is taken up for disposal at the admission stage itself.
The present writ petition came to be filed seeking issuance of writ of mandamus declaring the action of the fourth respondent in not granting dispatch permits of gravel over an extent of 2.00 hectares in Sy.No.116 of Thadi village, Parawada Mandal, Visakhapatnam District under A.P. Minor Mineral Concession Rules, 1966, as illegal, arbitrary and violative of the provisions of the Mines and Minerals (Development and Regulation) Act, 1957. Learned counsel for the petitioner submits that without taking any steps for establishment of Logistic Park, non-issuance of dispatch permits of gravel is illegal.
On the other hand, the Government Pleader for Mines and Geology would submit that non-issuance of dispatch permits would not arise since the petitioner has not made any application for issuance of dispatch permits.
That being the position, the writ petition is disposed of directing the petitioner to apply for dispatch permits, in which event the respondent authorities shall consider the same in accordance with law, at the earliest. No order as to costs. Consequently, miscellaneous petitions, if any, pending in
this Writ Petition shall stand closed.
