Heard the learned counsel for the petitioners and the learned Public Prosecutor.

The petitioners who are A1 to A3 in SC No.110 of 2016 which arose out of Crime No.126 of 2015 of V.Madugula Police Station, Visakhapatnam District, filed the present Criminal Petition under Sections 437 and 439 of the Code of Criminal Procedure, 1973, seeking enlargement on bail in the above crime registered for the offences punishable under Section 20(b)(1) read with Section 8 (c) of the Narcotic Drugs and Psychotropic Substances Act, 1985. A charge sheet came to be filed for the above said offences. 3.
At the time when the matter is taken up for hearing, learned counsel for the petitioners submits that he is not pressing the bail application insofar as petitioner Nos.2 and 3 are concerned. 4.
Accordingly, insofar as petitioner Nos.2 and 3 are concerned, this Criminal Petition is dismissed as not pressed. Insofar as petitioner No.1 is concerned, learned counsel for the petitioners submits that petitioner No.1 is suffering with kidney failure and as such seeks bail. But the medical reports filed, does not anywhere clearly indicate about the health condition of petitioner No.1. But, however, learned counsel for the petitioners submits that if a report is called for, truth will come out.

Having regard to the facts and circumstances stated above, petitioner No.1 shall make an application before the trial Court seeking bail on medical grounds, in which event, the same shall be dealt with after calling for the report of the local medical officer, in accordance with law.
