The matter is listed today under the caption 'for dismissal'. The learned counsel for the appellant reported that respondent No.2 died long back, but no steps were taken to implead the legal representatives of deceased-respondent No.2. Hence, the appeal is dismissed against respondent No.2 as abated by operation of law. Despite listing the matter under dismissal caption, learned counsel for the appellant sought time, but this Court is not inclined to grant time.

Hence, the appeal is dismissed for non-prosecution insofar as respondents 1 and 3 are concerned, but without costs. In consequence, Miscellaneous Petitions, if any, pending in this Appeal shall stand dismissed.
