The case of the petitioners is that they were issued notice in R.C.B.21/2017, dated 31.03.2017 asking them to vacate the land in occupation in Sy.No.305/1 to an extent of Ac.0.08 cents situated at Kallukunta Village, Pedda Kaduburu Mandal, Kurnool District, without an prior notice to the petitioners. Aggrieved by the same, the present writ petition is filed.
Learned counsel for the petitioners submits that the impugned notice was issued to the petitioners without any prior notice, which is in violation of principles of natural justice.
Heard the learned Assistant Government Pleader for Revenue.
It is to be seen that the impugned notice was issued to the petitioners asking them to vacate the subject premises. In view of the above, it is open for the petitioners to submit explanation in pursuant to the impugned notice dated 31.03.2017 within a period of three (03) weeks from today and on such explanation being made by the petitioner, the 3rd respondent is directed to consider the explanation of the petitioner and pass orders within a period of four (04) weeks from the date of receipt of copy of this order, after issuing notice and affording an opportunity of hearing to the
petitioners.
Till such time, there shall be stay of dispossession. If petitioner fails to submit explanation within the aforesaid period, it is open for the 3rd respondent to pass appropriate orders and take action accordingly. There shall be no order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 27.04.2017 dv
