ORDER:

This writ petition is filed for a mandamus to set aside proceedings bearing No.9280/E3/BDS/2011, dated 19.09.2011, of respondent No.1, whereby the petitioner was discharged from BDS Course on the ground that he failed to clear I year BDS University Examination in all subjects within three years from the date of admission. At the hearing, there is no representation for the petitioner.

Sri G.Ravi, learned counsel, representing Sri A.Prabhakar Rao, learned Standing Counsel for Dr.NTR University of Health Sciences, submitted that as per the Regulations of the Dental Council of India which are adopted by the Dr.NTR University of Health Sciences, if a student does not clear I year BDS University Examination in all subjects within three years from the date of admission, he/she shall be discharged from the Course and that as the petitioner has failed to clear all the subjects of I year BDS Course within three years from the date of his admission, he was discharged from the BDS Course under the impugned proceedings.

In my opinion, as the petitioner failed to clear all the subjects of I year BDS Course, he is not entitled to be continued in the said Course following the Regulations made by the Dental Council of India and therefore, no mandamus can be issued in his favour for allowing him to continue the Course. Hence, I do not find any merit in the writ petition and the same is accordingly dismissed.

As a sequel to dismissal of the writ petition, W.P.M.P.No.17611 of 2012 shall stand disposed of as infructuous.
