HONOURABLE SRI JUSTICE A. SHANKAR NARAYANA SECOND APPEAL No.95 OF 2013 JUDGMENT:

Sri K. Anil Kumar, learned counsel, on behalf of Sri Nimmagadda Satyanarayana, the learned counsel for the appellant, seeks permission to withdraw the present Second Appeal on the ground that the possession was already delivered, having vacated the premises, and requests for dismissal.

Sri T. Rajendra Prasad, the learned counsel for the respondent is also present.

In view of the submission made by the learned counsel for the appellant, permission is granted to withdraw the present Second Appeal and, accordingly, the same is dismissed as withdrawn. No order as to costs.

As a sequel thereto, Miscellaneous Petitions, if any, pending in the Second Appeal shall stand closed.
