ORAL ORDER:

Alleging that petitioner violated building permission granted and has put up ventilator facing the neighbour's house, a complaint against the petitioner is filed stating that ventilator put up by the petitioner is causing lot of hardship to neighbour. Pursuant to the said complaint, notice is issued by the respondent Gram Panchayat on 2.9.2015. Petitioner submitted sanctioned plan and other documents. Thereafter impugned notice is issued directing the petitioner to remove the ventilator within 15 days. Petitioner challenge the same.

2. When the matter is taken up, learned counsel for petitioner submitted that petitioner has submitted his explanation dated 7.10.2015 and after considering the same appropriate order may be passed.

3. Heard the learned counsel for petitioner and learned standing counsel for respondent Gram Panchayat and with their consent the writ petition is disposed of at the admission stage.

4. Having regard to the same, without expressing any opinion on the merits of the matter, the writ petition is disposed of directing the third respondent Gram Panchayat

to treat the representation of the petitioner dated 7.10.2015 as explanation to the notice dated 18.9.2015 and after affording reasonable opportunity of hearing to 4th respondent pass appropriate orders as warranted under law within four weeks from the date of receipt of copy of this order. Till such orders are passed no coercive steps shall be taken against the petitioner. No costs. Miscellaneous petitions, if any, shall stand closed.
