THE HON'BLE SRI JUSTICE M.S.RAMACHANDRA RAO WRIT PETITION No.30977 of 2015 ORDER:

Heard the learned counsel for petitioner and Smt.B.Vijayalakshmi, learned Standing Counsel for 3rd respondent. 2.

Petitioner has filed this Writ Petition challenging the action of 3rd respondent Bank in seeking to retire him on attaining the age of 58 years on 30-09-2015.

On 22-09-2015, this Court directed that the petitioner be continued in service until further orders.

Subsequently on 29-06-2016, this Court modified the order and directed the respondents to take a decision with regard to age of superannuation taking into consideration the provision of Section 115-D(iv) of the A.P.Cooperative Societies Act, 1964 and also memos of the Government issued from time to time within four (04) weeks and directed the petitioner to continue in service till 31-07-2016. 5.

Subsequently, the 3rd respondent Bank took a decision not to enhance the age of superannuation in respect of its employees. 6.

Therefore no relief can be granted to the petitioner in the Writ Petition. However, the petitioner would be entitled to wages for the period from 30-09-2015 till 31-07-2016.

MSR,J W.P.No.30977 of 2015 -27.

The Writ Petition is accordingly disposed of. No costs. 8.

As a sequel, miscellaneous petitions pending if any, shall stand closed.
