THE HON'BLE THE CHIEF JUSTICE SRI THOTTATHIL B. RADHAKRISHNAN TRANSFER CRIMINAL PETITION No.193 OF 2014 ORDER:

None appears for the petitioner.

2. This is an application seeking transfer of a case. There has been an interim order on 5.9.2014 that the personal presence of the petitioner-accused is dispensed with before the trial Court, unless it is specifically required. It was also clarified that the pendency of the Transfer Criminal Petition would not come in the way of the Magistrate in further proceeding with C.C. No. 817 of 2011. There is no submission on behalf of the petitioner that the said case is pending and the ground for transfer still continues.

3. Having perused the pleadings, I am satisfied that all that is required is to ensure that the interim order dated 5.9.2014 is maintained as regards the question of appearance of the accused. Therefore, maintaining the order dated 5.9.2014 and making it absolute, this Transfer Criminal petition is closed.

4. Miscellaneous applications, if any, pending, shall also stand closed.
