THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 7948 OF 2019 O R D E R:

Petitioner seeks a mandamus to the respondent Corporation to consider her Application for permission to raise a building in Plot No. 204 in Nallagandla Residential Complex in Survey Nos. 302 to 310, 320 to 322, 324 to 361, 363 to 365, 384, 385, 387 to 391 and 399 situated at Nallagandla Village, Serilingampally Mandal, Ranga Reddy District.

The petitioner made an Application expressing her intention to construct a residential building in the subject plot, to the 2nd respondent, on 12.04.2018 along with plan and other relevant documents seeking permission, and thereafter, on 24.12.2018, she made a representation to the Revenue Divisional Officer with a request not to widen the existing 80 feet road to 100 feet and to 150 feet. The petitioner was served the notice dated 26.04.2019 pointing out certain deficiencies.

Heard learned counsel for the petitioner and Sri Sampath Prabhakar Reddy, learned Standing Counsel for the respondent Corporation.

There is no dispute that part of the land is under acquisition. Hence, the petitioner is at liberty to make an Application afresh after conclusion of the land acquisition proceedings precisely setting out the area over which she seeks to get permission. As and when such an Application is made, in accordance with the procedure prescribed, the same shall be considered and processed by the authorities.

The Writ Petition is disposed of. No costs.

Consequently, the miscellaneous Applications, if any shall stand closed.
