SMT JUSTICE T.RAJANI CRIMINAL PETITION No.2457 OF 2018 ORDER:

This Criminal Petition is filed seeking for grant of anticipatory bail to the petitioner, who is the sole accused, in Crime No.84 of 2018 on the file of the Station House Officer, Raidurgam Police Station, Cyberabad District. The offences alleged are under Sections 420, 468, 470 and 471 of I.P.C.

Heard the learned counsel for the petitioner, learned Public Prosecutor appearing for the respondent-State, and perused the record. 3.

The case of the prosecution is that, the petitioner, who is the husband of the de-facto complainant, created fake learning permit, fake pan card, in the name of the de-facto complainant, by forging her signatures, and also availed loans, by showing the de-facto complainant as guarantor, without her knowledge, and utilized the money for his personal use.

Learned Public Prosecutor contends that the case requires custodial interrogation of the petitioner, as the genuineness of the aforesaid cards would only come to light after their seizure from the petitioner.

Hence, considering the above, this Court is not inclined to grant anticipatory bail to the petitioner and as such the Criminal Petition is dismissed.

However, considering the submission of the petitioner's counsel, that the de-facto complainant already filed a case, under Section 498-A I.P.C., against the petitioner and the petitioner obtained bail therein, this

Court is inclined to direct the Police concerned to issue Section 41-A Cr.P.C. notice to the petitioner, upon furnishing his permanent address, before effecting his arrest.

Accordingly, with the above observation, the Criminal Petition is dismissed.

As a sequel, the miscellaneous applications, if any pending, shall stand dismissed.
