Gajjala Karthik v. The State Of A.P.,
SMT JUSTICE T.RAJANI CRIMINAL PETITON Nos.2447 OF 2018 & 2449 of 2018 COMMON ORDER:
These petitions are filed seeking for grant of anticipatory bail to the petitioners, in the event of their arrest in Crime No.141 of 2016, on the file of China Chowk Police Station, Kadapa District. The offences alleged are under Sections 416, 419, 420, 463, 465, 468, 471, 34, 120-B of IPC and Section 156(3) of Cr.P.C. 2.
Heard the counsel for the petitioners and the Public Prosecutor appearing for the respondent.
3.
The case of the prosecution is that the petitioners are the attesters of the documents, which are in dispute. The property, which belongs to the de facto complainant was sold away by the third party. The confession of the person, who sold the property, shows that A-5 & A-6 were in know of the fact that the document is not a genuine document. These petitioners are stated to be brothers of A-5 & A-6 respectively. Hence, there is every reason to believe that these petitioners also conspired with A-5 & A-6 to get the documents registered in the names of A-5 & A-6. 4.
Hence, in view of above facts, this court opines that these are not fit cases for granting anticipatory bail to the petitioners. 5.
Accordingly, the Criminal Petitions are dismissed. 6.
As a sequel, miscellaneous petitions pending consideration, if any, in these cases shall stand closed.
