THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 7337 of 2017 O R D E R:
Petitioner asserts that his grandfather is having land admeasuring Acs.20.25 guntas in Survey Nos.502/1500, 502/1502 and 502/1503 of Manuguru Village, Khammam District; that after his death, his father is the sole surviving legal heir and after the death of his father, the above said land was taken over by respondent No.2Chief Manager, Singareni Collieries Limited, Manuguru Open Cost Project, Khammam District, for the purpose of Manuguru Open Cost Project and that he was not paid any compensation for the same. Hence, he filed this writ petition seeking a mandamus. Learned Government Pleader for Land Acquisition, on instructions, submits that the subject land was an assigned land and on account of the violation of the assignment conditions, the assignment was cancelled and the petitioner is not entitled for any compensation.
In view of the above said submission, and having regard to the fact that admittedly, as on date, the respondents had not communicated the reasons for not paying the compensation to the petitioner, the writ petition is disposed of with the direction to respondent Nos.3 to 5 to act on the representation, dated 13.02.2017, and if the petitioner is not eligible to be paid compensation, they shall communicate the same by clearly setting
out the reasons therefor within a period of eight weeks from the date of receipt of a copy of this order.
