THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No. 24493 of 2017 ORDER:
Pursuant to the tender notification issued by the respondents for establishing shops, petitioner submitted her tender by paying EMD amount in respect of a shop bearing No.OC8&OC9. After opening the tenders, she became a successful tenderer. Immediately thereafter, the Andhra Pradesh State Road Transport Corporation thought it fit to utilise the said shop area along with other area of which the lease expired in July, 2017, for the purpose of establishing a godown for its cargo service. In those circumstances, the tender quoted by the petitioner was cancelled and the EMD amount was returned. Challenging the communication of cancellation of tender dated 14.07.2017, the present writ petition is filed. By virtue of the impugned communication, the respondents cancelled the tender quoted by the petitioner in respect of the aforesaid shop. However, the respondents should have taken a decision for utilising the said area before finalisation of the tenders but after finalisation of the tenders, they should not have cancelled the tender of the petitioner.
Be that as it may, in view of the decision taken by the Corporation to utilise the said shop area along with other area, if
the Corporation wants to let-out the shop within one year, it shall let-out to the petitioner only on the agreed tender value. Beyond the period of one year, it is open to the respondents to take appropriate steps.
The writ petition is accordingly disposed of. Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. ________________________ A.RAMALINGESWARA RAO,J Dt:31.08.2017 kdl
