THE HON'BLE SRI JUSTI CE A.RAMALI NGESWARA RAO Writ Petition No.6621 of 2018 Order:

In spite of granting ten days time on 28.02.2018, learned Government Pleader could not get any instructions. In the circumstances, this Court is constrained to dispose of the present Writ Petition on the basis of the averments made in the affidavit filed in support of the Writ Petition.

The petitioner states that his paternal uncle was a protected tenant in respect of the land of an extent of Ac.15-03 gts., in Survey No.53, Ac.12-02 gts., in Survey No.55 and Ac.6-29 gts., in Survey No.425, totally admeasuring Ac.34-33 gts., situated at Rimmanaguda village, Gajwel Mandal, Siddipet District and the original owner of the said land is one Fathima Begum. The paternal uncle of the petitioner is entitled for share as protected tenant. The petitioner filed an application on 08.10.2015 for grant of succession as a legal heir of Chintapalli Anjaiah in respect of the above land. Though the third respondent issued notice to the affected parties pursuant to the application, when no further enquiry was conducted and no final orders were passed, the present Writ Petition is filed.

As per the papers filed along with the Writ Petition, it is noticed that the application filed by the petitioner was taken up in File No.B/2562/2015 and the petitioner also states that initially a notice was issued to the parties and thereafter no proceedings took place. In the circumstances, without going into the merits of the case, the third respondent is directed to consider the said application and pass appropriate orders thereon within a period of eight (8) weeks from the date of receipt of a copy of this order.

The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this writ petition shall stand closed.
