THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI SECOND APPEAL No.1120 of 2009 JUDGMENT:- This Second Appeal, under Section 100 of the Code of Civil Procedure, 1908, by the appellants/unsuccessful plaintiffs, is directed against the decree and judgment dated 17.07.2009 of the learned II Additional District Judge, Madanapalle, passed in A.S.No.101 of 2006. While dismissing the said appeal, the learned Additional District Judge had confirmed the decree and judgment dated 08.11.2006 of the learned Senior Civil Judge, Madanapalle, passed in O.S.No.55 of 1991. 2.

Today when the matter is called, Sri M.N.Narasimha Reddy, learned senior counsel for the appellants submits that the parties had settled the matter out side the Court and had instructed him to withdraw this appeal. Therefore, he seeks permission of this Court to withdraw the appeal.

3. Recording the said submission of the learned senior counsel for the appellants, permission is accorded to withdraw the appeal.

4. Accordingly, the second appeal is dismissed as withdrawn. There shall be no order as to costs.

Miscellaneous petitions pending, if any, in this appeal shall stand dismissed.
